This privacy policy applies to your interactions with Affitto Motors LLC (“Company,” or “We”) through our websites, mobile applications, physical locations, customer service channels, and other services that reference or link to this privacy policy (collectively, the “Services”). These Services may include both online and offline activities, such as using our digital platforms, visiting our premises, or communicating with us directly. This privacy policy may be supplemented by additional notices or terms provided at the time your information is collected. 

The Types of Information We Collect 

We collect information about you in three main ways: through information you directly provide to us, from third-party sources, and through automatic data collection when you interact with our Services. 

Information You Provide to Use 

The types of personal information that we collect directly from you depends on how you interact with us and the Services, which may include: 

  • Contact details, such as your name, email address, postal address, birthdate, government identification, and phone number; 
  • Payment and billing information, such as credit or debit card numbers, billing address, and transaction details; 
  • Insurance information, such as insurer name, policy number, coverage details, and documentation required for vehicle rentals or incident claims; 
  • Health and medical information, such as details about relevant health conditions necessary to provide adaptive driving devices or other accommodations for a safe and comfortable rental experience; 
  • Account login credentials, such as usernames and passwords, password hints and similar security information; 
  • When you use our services, you may provide biometric information such as facial recognition or fingerprint scans for identity verification. 
  • Program-related identifiers, such as membership IDs, program IDs, and details indicating participation in corporate or rewards programs; 
  • Communication records, such as emails, call recordings, and chat messages with our customer service or roadside assistance teams; 
  • Travel-related information, such as flight numbers, arrival times, and travel itineraries if you choose to link or provide them; 
  • Comments, feedback and other information you provide to us, including search query data survey responses, and questions or information you send to customer support; and/or 
  • Interests and communication preferences, including preferred language. 

Information Gathered from Third Party Sources 

  • We also may obtain contact details and other information about you from our affiliates and from other third parties, including: 
  • Travel booking platforms and other reservation channels; 
  • Service providers, such as car maintenance and roadside assistance companies;
  • Licensees, including franchisees and partners in our rental network; 
  • Airlines, hotels, and membership clubs that share booking or loyalty program details; 
  • Payment card companies, including billing information and transaction details; 
  • Advertisers and other business partners who share marketing or promotional data; 
  • Employers (for corporate rentals or employee benefit programs); 
  • Social media platforms, consistent with your sharing preferences and privacy settings; 
  • Information from vehicle manufacturers and in-car technology providers, such as Apple CarPlay, which may collect telematics or personal data in accordance with their own privacy policies; 
  • Biometric data processed by third-party verification services such as QuickPass, used solely to authenticate your identity. 
  • Other third-party sources that are legally permitted to share your information with us. 

Information Automatically Gathered 

  • We may also automatically collect information about how you and your device interact with the Services, including: 
  • Device and usage information, such as hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and activity on our Services, including access times, pages viewed, links clicked, and the page visited prior to navigating to our Services; 
  • Location information, which may include precise location data from your device, in accordance with your device permissions. You can disable the collection of location information at any time; 
  • Transaction data, such as rental price, transaction date, and location when making a reservation or booking a rental through our Services; 
  • Vehicle and telematics data, such as information collected automatically from vehicles equipped with telematics systems, onboard devices, or built-in technologies (“Connected Vehicles”). Connected Vehicles may provide information about vehicle condition, damage and accident events, performance, diagnostics, mileage, acceleration, braking, speed, fuel consumption, fuel level, tire pressure, odometer readings, location, direction, and movements as well as camera images (interior and exterior), and audio recordings (Collectively, “Connected Vehicle Data”). Connected Vehicle Data is typically associated with the vehicle but may be linked to you and treated as personal information. If you are unsure whether your rental vehicle is a Connected Vehicle, please speak to a member of our team at the rental location or contact us using the information provided in this Policy. 

Please always unpair your device and ensure that you take the necessary steps to remove your information from the system when you return the vehicle at the end of your rental period. If you do not do this, your information may be retained in the system and could be accessed by anyone who is authorized to use the vehicle. Connected Vehicle Data may be received by the manufacturer of the Connected Vehicle or the owner of the built-in service prior to it being received by us. 

The technologies we use for this automatic data collection may include: 

● Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when your browser interacts with our Services. 

● Flash Cookies. Certain features of our Services may use local stored objects (or Flash Cookies) to collect and store information about your preferences or your activity while interacting with our Services. Flash Cookies are not managed by the same browser settings as those used for Cookies. 

● Web Beacons. Our Services and emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email

and for other related Services statistics (for example, recording the popularity of certain website content and verifying system and server integrity). 

Cookies can be “Persistent” or “Session” Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser. 

How and Why We Use Your Information 

  • Depending on how you interact with us and the Services, We use your personal information to: 
  • To provide and manage our services, including creating and managing your account, activating and managing your access to the Services, processing and fulfilling reservations or other transactions, and administering your rental records and fees; 
  • To support vehicle features and enhance functionality, including enabling remote services such as contactless rentals, remote lock/unlock, engine disable, and automatic transmission of vehicle data (e.g., location, odometer, fuel level); 
  • To verify identity, including confirming your identity and validating identity documents; 
  • To provide technical and customer support, help maintain the security and functionality of the Services, diagnose problems, and ensure the Services work safely and as intended; 
  • To communicate with you, including responding to your inquiries and requests, providing updates about reservations or account activity, and sending transactional or service-related messages via email, phone, text, or push notification; 
  • To personalize your experience, including offering customized content, remembering your preferences, and tailoring promotions and advertising to your interests and location; 
  • To provide marketing and promotional content, including messages and offers about our products, services, events, contests, and those of our affiliates or trusted third parties, across various platforms including email, SMS, websites, apps, and social media; 
  • To conduct user research and promotional activities, such as inviting you to participate in surveys, beta testing, sweepstakes, or competitions; 
  • To analyze and improve our business, including identifying usage trends, performing audits, conducting research, testing new services, analyzing customer preferences and behaviors (including Connected Motorcycle Data), and evaluating the effectiveness of marketing and operational performance; 
  • To manage our fleet and services, including vehicle maintenance, enabling third-party vehicle apps, improving road safety, and recovering lost, stolen, or towed vehicles; 
  • To comply with legal obligations and enforce policies, including responding to legal requests, maintaining the safety and integrity of our systems and assets, preventing fraud, resolving disputes, enforcing agreements, and complying with applicable laws and regulations; 
  • To support business transactions, such as evaluating or completing mergers, acquisitions, asset sales, restructurings, or other corporate transactions where personal information may be part of the transferred assets. 

How We Share Your Information 

We may share Your personal information in the following circumstances: 

● With Service Providers: We may share your personal information with third-party vendors, contractors, or agents ("Service Providers") who perform services on our behalf. These may include services such as payment processing, customer support, marketing, IT services, telematics data analysis, and identity verification. These Service Providers are contractually obligated to protect your information and use it only for the purposes specified by us. 

● For Business Transfers: We may disclose or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company. 

● With Affiliates: We may share your information with our affiliates, including our parent company, subsidiaries, joint ventures, or other companies under common control, provided they are bound by this Policy. 

● With Business Partners: We may share your information with trusted business partners to offer you products, services, or promotions that may be of interest to you, such as insurance providers or travel affiliates. 

● With Other Users: If you post information in public areas while interacting with our Services, such as reviews or forums, that information may be accessible by all users and the general public. 

● With Law Enforcement or Regulators: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency), including to meet national security or law enforcement requirements. 

● With Your Consent: We may disclose your personal information for any other purpose with your explicit consent. 

Data Retention 

We may retain your information for as long as you have an account with the Company, as needed to provide you our Services, or as otherwise necessary for the processing purposes for which the information was originally collected and any other legitimate business purpose, including, for legal, archival, accounting, and/or audit purposes. 

To determine the appropriate duration of the retention of personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, and whether we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations. 

Once retention of the personal information is no longer necessary for the purposes outlined above, we will either delete or de-identify the personal information or, if this is not possible (for example, because personal information has been stored in backup archives), then we will not further process the personal information until deletion or deidentification is possible. 

How Information is Protected 

The security of personal information is important to us. We take reasonable steps designed to protect personal information from unauthorized use, access, disclosure, alteration, destruction or loss. You are responsible for keeping your account safe. Do not share your passcode, membership and pin numbers with anyone. Please be mindful that hackers and scammers may impersonate us or our website. If you suspect an unauthorized use or security breach of your information, you must notify our customer service as soon as possible! We are not responsible or liable for any loss or damage if your account passcode, membership numbers and pin numbers are stolen or used inappropriately.

Our Services may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. 

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. 

Children Under the Age of 13 

Our Services are not intended for children under 13 years of age. No one under age 13 may provide any information to us. We do not knowingly collect personal information from children under 13. If you are under 13, do not register for our Services, make any purchases or reservations through for our Services, use any of the interactive or public comment features of our Services or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. You can stop sharing the location information of your mobile device through the applicable Affitto App by turning off location services or by uninstalling the App. If you would like to uninstall the Affitto app: Use the standard uninstall processes as may be available as part of your mobile device or via the application marketplace or network from which you downloaded the app. You may also be able to limit mobile interest-based advertising through the settings on your mobile device by selecting “Ask Apps Not to Track” (iOS) or “opt-out of interest based ads” (Android). 

You may also be able to opt-out of some – but not all – interest-based ads served by mobile ad networks by visiting http://youradchoices.com/appchoices and downloading the mobile AppChoices app. You may be able to limit the use of location data for advertising purposes by adjusting your location services settings on your mobile device. 

Your California Privacy Rights:

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. The following disclosures only apply to residents of the State of California.

The Right to Know
